Unsure if this proper forum for my current problem, so I'll apologize in advance if not.

I had documents left in the door handle at my home. Almost unreadable as was rained on before finding them. (Oct 8th, 2018)

Quick refernce...

Smith County TX

filed with County Clerks Office

By Atty Roberto Jaramillo (Dallas)

absolutely blank "cert of delivery"

filed County Court of Law

Amount $979.26

Original Creditor: Capital One Bank (Credit Card)

Documents seem to be identical to most other documents posted here concerning same subject(s).

Clerks Date: 7th day of Sept 2018 as signed, filed Sept 6th 2018.

Original Petition & First Discovery Requests attached.

Before going any further, I need to add that this particular account was not my account. I found out after receiving a statement from creditor for a card that had maxed to limit (+/- $10). Called creditor to inform this was and had never been an account that I had applied for, recieved, and it ever used. They asked if I wanted to consider this being a fraudulent account and I answered "yes". They stated that if I did not make payments on account during investigation that it would go to credit report accordingly " good or bad" until investigation was complete. I made a 3 payments and due to financial at the current time, subsequently stopped. No resolution from that complaint.

I filed Disputes with Credit Bureaus as well concerning this account not being my own. They just simply returned dismissed basically.

I am unsure how to proceed with this issue concerning lawsuit. Any advice would be greatly appreciated as they are now attempting to serve this at my place of employment which has in the past with others been grounds for termination.

Thank You for Time and Consideration.
