Being sued by Midland Funding and hoping to get them in arbitration. My questions are

1. Who pays the initial arbitration fee?

2. Who pays the ongoing fees?

3. If I lose, am I responsible for the cost of the other party as well?

Look at your cardmember agreement for the OC for answers to this.  Especially who pays the initial fee.   Some agreements say the creditor pays the initial fee.

Also look at the arbitration forum rules.  JAMS limits the consumer to only the first $250.  The other party pays the rest.
