JD70 Posted November 6, 2018 Report Share Posted November 6, 2018 Could someone tell me what the SOL is on a credit card debt in FL? I have read a revolving acct / open-ended account is four years (which would be a credit card). On the Paper I received from the court, it is checked Contract but there is no where on the paper to check debt collection (which is what this is). Is this from the last payment you made on the card or do you have to add time for when the lawsuit was filed? I read that somewhere. nobk4me Posted November 9, 2018 Report Share Posted November 9, 2018 Also, Florida has a borrowing statute, such that if the creditor uses the laws of another state with a shorter SOL, the shorter SOL is binding, instead of Florida's. The case law was LWT v. Brodsky (2006). A lot of these creditors use Delaware law, where the SOL is 3 years. Examples: Discover, Chase, Bank of America.
