Hardship

I need help with Johnson Mark LLC judgement suit for PRA LLC in which I am unable to get one account approved for hardship, while another was approved.

i have only $900 per month disability income and live in public housing in state of HI

my debt is from 2012/13 before an accident left me unable to pay debts since then.

they have sent me stipulated judgement papers for payments it would be a hardship for me to make, and I am seeking help in getting dismissal, if possible

thank you very much

Contact PRA directly NOT the law firm.  See if they will do a hardship discharge because you entire income is disability and cannot be garnished or levied.  I believe they have a policy that if that is your circumstance they will cease collections.

Make sure you do not keep more than $1800 in the account the disability check is deposited into.  As long as that is the case they cannot levy the account.

Otherwise if they will not give you a hardship discharge ignore them.  They cannot levy or garnish your disability so there is nothing else for them to collect.

Than you.

I think maybe I didn't put enough information on here... from what I saw on the other posts about these situations,

i am really efforting to not get a judgement (still not sure if stipulated is actually one, anyway) and avoid any opportunity for garnishment.

a couple big what ifs come up!

what if one debit card/account is not enough to get by in this techno reality we live in?

i have old accounts I often use by putting Some of my fixed income in... for various different reasons:/needs.

Also, what if I actually got a little extra income? But not enough to immediately pay off 4 figures of garnishment?

if I have a judgement, I can pretty much have $1800 in one account max for potentially many years! And not do any other banking for a long time.

This is why, barring my success with getting PRA to respond with a 'hardship', I am staring at the anyday now deadline of the stipulated judgement for a small monthly payment for 20 years, in order to avoid those possibilities resulting from my exceeding the 15 days they are saying I have to sign it & start paying.

i don't know what will happen if I don't send it real soon, and have a 3rd date in court in about 60 days.

When I went last time it was just an outside attorney who was hired to just say we might not have to come back if I sign the stipulated judgement they were sending me - have now provided.

should I not sign it & keep going back to court, hoping I can later, to avoid judgement? Hoping I might get lucky they don't have all there ducks in a row?

i don't feel like I have enough info to disregard the deadline for too long...

thabk you so much for answering!

Sports Chalet, a store in SoCal... can't recall the cc corp.

It was March '13 when I became disabled and couldn't pay my debts any longer, and I don't remember. I think hbsc or cap 1 maybe. If it matters I could likely find out.

PRA says they don't have Hardship Review, after speaking to several people/managers  in different depts, because they "can't talk about" what they gave Johnson Mark to go after garnishment of my $906 Ssdi sole income.

They cannot garnish SSDI under ANY circumstance.  They cannot levy your bank account it goes into.  DO NOT deposit any other money other than the SSDI into that account.

DO NOT sign this.  It does not matter if they get a judgment.  They cannot collect on your SSDI.

DO NOT do this.  Once you move the money to other accounts it is no longer protected.  They can seize it.

Keep it in cash or a prepaid debit card NOT the bank.

NO!  You can have no more than 2 times your SSDI in the account each month that the SSDI is deposited into.  ANY money in other accounts is NOT safe even if it started in the SSDI account.  Only use ONE bank account.

They get a judgment they cannot collect on.

DO NOT sign.  No reason to avoid a judgment.  They cannot take your SSDI.  Don't worry about the judgment.

The stipulated judgement is a $10 month payment.

Only real reason I worry about the judgement is I would only be able to use one bank account, and it's a little complicated cuz of where I live, and bank availability & stuff, it would def be worth like $5 a month to avoid it, but $10 starts to cut into a tight budget... :)

i totally understand about the 2x limit, and inability to garnish my ssdi, thank you
