Trying to get prepared...Florida

Good Morning, my anxiety has been super high and I am not sure if its too much information at once or what but I am so overwhelmed. I received a "pre legal" noticiation from Midland funding regarding an Old Navy credit card account through Synchrony Bank. I sent a debt validation letter about 20 days ago and still have not heard anything as of yet. I am trying to get prepared the best way possible. I am in Florida. After reading through some threads I see that arbitration  is the best option and that I should file a MTC. I do not want to hire an attorney so I want to do as much as possible on my own. How do I find a sample MTC for the state of Florida?

Did the “pre legal” notification contain the 30-day validation notice?

No, it did not have any documents.

I think you misunderstood.  It didn’t have to contain documents.

You stated that you sent a debt validation letter.

Did the “pre legal” notification contain language that said you have 30 days to dispute the debt and that if you dispute in writing, they will obtain verification?

No it did not. But I was told by others on this forum to send a debt validation letter on my own.

In your other thread, I asked you if the letter contained the 30-day notice, but you didn’t answer.

Since the letter didn’t contain that language, it was probably not ther first letter to you.  As a result, your validation request was sent outside that 30 day period, and they are not required to respond.

The following thread contains a sample MTC that can be used in any court because the cited case law is from the United States Supreme Court.
