Harry Seaward
I don't have any specific advice re: the hearing, but appreciate you letting us know the status. We now know Barclays will pay, anyway. Do you have any claims against Barclays? Do you have valid disputes over the balance they claim or their billing practices? Believe it or not, the few months leading up to the scheduled phone conference there were no real lawyers attached. The emails were fairly generic. Today i received an acknowledgement from the law firm in regards too the AAA email. Now i have someone to potentially negotiate with. I have no claims against Barclays per se. I do have questions over balances and statements, as they provided me only only the last few statements in court. The end balance and suit were different as well.i think a n extra month of fees may have been added. Small things. Phone conference set for the end of the month. what? lol, seriously? They paid the $300 filing fee, $2500 arbitrator fee, $1400 case fee, on a $3400 debt? So $4200 < $3400. Lawyers must be math geniuses. What happened with the case? This isn't at all uncommon with OCs. And the lawyers don't make the decision to arbitrate.
fisthardcheese
Barclay's sometimes pays the initial fees but in most cases, we see them settle in the end. They are not as aggressive as an Amex or Discover.

Is there another retaining bill for the arbitrator coming? if so, when does that happen? I have also sent an email to the lawyer asking for settlement, but have heard nothing. They likely have another bill right now for $2500 which likely has a due date just before your first phone conference. At the phone conference, you need to make sure to ask to conduct discovery, ask for the name of Barclay's witness they are bringing (the attorney can not testify to your account records) and ask for an in person hearing. These things must be asked and argued for in AAA, as they are not automatically issued. If they have not responded to your settlement offer by the day of this phone conference, I would send the offer again shortly after the phone call concludes and make sure to set an expiration date. I usually make the expiration date a day or 3 prior to the next big date set by the arbitrator (such as the conclusion of discovery).

fisthardcheese
Possibly. I would resend your offer with an expiration date of about 2 weeks prior to the hearing.
