Mike Phillips Posted January 6, 2019 Report Share Posted January 6, 2019 Thanks to defense instructions found in threads on this site, my daughter in law (DIL) successfully defended a credit card claim for $2300 in Mag Ct. My sense is that the counterclaim made the difference, as a settlement was reached with Plaintiff's counsel in the hall, whereby she offered to dismiss the complaint with prejudice if DIL would dismiss CC with prejudice. Pleadings filed by DIL attached. Many thanks to Clydesmom for her sage GA advice. fisthardcheese Posted January 7, 2019 Report Share Posted January 7, 2019 In GA Magistrate Courts, the way to beat a collection lawsuit is either by a counter claim or by asserting arbitration in the card agreement.
