I'm being sued for two Synchony accounts. Very unsure has to how to handle this matter. I have to answer the summons ASAP;  I received some help on how to answer but I'm still unclear if anything else is needed because one summons includes a request for disclosure and one does not. 

Should I be requesting disclosure for both?

How should my answer look?

And what's arbitration? What's the process? Can these cases be dismissed?

Someone please HELP!!!!!!!!! I attached the requested section of the summons.

Synchrony has the BEST arbitration clause of all the creditors.  Motion to compel arbitration in both cases.

You do NOT want to engage in discovery if you are going to pursue arbitration.  Texas has it on their books if you participate in the legal process you waive your right to arbitration.  I would also raise arbitration as my affirmative defense.

You need to start researching how to answer, defending yourself vs trying to get them to drop it by getting an approved MTC arbitration.  It is not good if we do all the work for you because none of us will be in court with you to argue the motion or the case.

Yes, but it isn't that simple.  There must be a legal reason for the court to approve a motion to dismiss from you.  There is not enough information in your first post to determine if that is even possible.  

They are not just going to go away.  WHO is the plaintiff?  If it is a JDB and you get a MTC arbitration granted they will dismiss and drop it.

Thank you for your response. I'm doing my best in researching arbitration; What is MTC arbitration? Do you know of any creditable sites that could further break down arbitration for me?

And the plaintiff' is Portfolio Recovery Associates, LLC; I believe they are a JDB, not sure.
