Kazzanova Posted January 28, 2019 Report Share Posted January 28, 2019 Hello, I was being sued in Civil Court and had a motion approved to Compel Arbitration. After I filed all the paperwork with JAMS, Cavalry SPV I, LLC & Myself both mutually agreed on a Settlement Agreement & Mutual Release where we both walked away. where is specifically states that "Cavalry will cause any litigation that it filed regarding the debt to be dismissed with prejudice". I called the court to make sure everything was all dismissed and taken care of as per agreement and was told by the court that the case was still on hold pending arbitration. Did your settlement agreement specify how long they had to dismiss the case? If not, then no. How long has it been since you both signed the settlement? I dismissed my claim with JAMS upon signing the agreement as stated in the agreement. Send an email to the attorney reminding him that under the settlement agreement they were required to dismiss with prejudice and he has 7 business days to fulfill the contract.
