Pique
I received a "robo-call" on my cell phone Thursday and all it said was "My bank accounts and tax returns will be seized if I did not call 866-***-****.". I was driving at the time on my hands free and couldn't write down the number. I later looked at my call list and found original number where the call was generated from and called it back. I got a recording and left a message that I got a call from this number and couldn't understand it, I left my number. The next morning I got a person who called me and said to sum it up, was collecting on a past debt of a credit card. I asked him the name of the card, I don't recall ever having that card and quite possibly in the time frame he spoke of 1999-2009 my ex wife (divorced in 2006) could have opened the account. He stated that the debt hasn't been paid on since 2009. This debt hasn't been on my credit report and there has never been any correspondence between myself and this company. Does the SOL apply ? He never gave me a mailing address or anything to contact them, should I just wait to hear from them again?
wernda1234
Thank you for posting, Pique. While I am not a Maine resident, I got a similar call a few months ago, and it was a scam. When I finally got a person on the phone, they couldn't provide any details about the alleged debt, and I feel like they were "phishing" for information for identity theft. I asked them to send me a written statement and hung up. As I understand it, SOL only applies if you are sued. SOL doesn't keep a JDB from trying to collection, only from suing for a debt outside of it.
Pique
Thank you for responding............Honestly I thought as much in the "scam" call idea and "phishing". Since I gave my phone number anyone can do a reverse look up, as well as any one with nefarious plans could pay to get the full reports. Name, address, last addresses and relatives and such. Maine has a 6 year statute as well as MA where I used to live, back in the time frame he said this is from.
fisthardcheese
100% Scam. No one other than the Government can just seize anything without a court order first. Since you have not been sued, that would be impossible.
Pique
Although back in my mind I knew that. But, of course the call catches you off guard. I do have a question as this person that called, after the robo call, stated there has been no payment or communication since 2009. Is there a phrase that is used to stop the calls? I saw one in a post that someone claimed was all you had to say. It was a nice way to say, you haven't pursued this in a timely matter, so go away..
