Napoleonesco
Hello, I was recently served a summons for a lawsuit initiated by Midland Funding LLC. The debt of $1,071 was originally owed to Syncrony back in 2017, I'm wondering if there is any chance of me beating them in court?
Harry Seaward
Not really. Best way to deal with this is arbitration. https://www.creditinfocenter.com/community/topic/329436-arbitration-overview-and-strategy-2018-most-up-to-date-info/
Brotherskeeper
@Napoleonesco When you get a chance please post the complaint with your identifying info redacted so that we can best help you. I know this a lot to read and absorb all at once, not to mention frightening. When is the deadline to submit your answer? Are you being sued on an account stated cause of action? Is there an affidavit attached to the complaint? If yes, you will need to include your own affidavit with your answer. Here are a 2 threads for you to read from Michigan members, in addition to the great arbitration thread @Harry Seaward linked to above: @bureabe is a few steps ahead of you: LabLady's case was Midland/Synchrony Bank Amazon:
