Mariah
Hi Everyone, I recently recieved a letter stating that I am being sued by midland funding for a debt of $800. About 2 years ago I opened a tjmaxx card with a credit limit of $500. At the time I was an undergrad and failed to pay off the remaining balance. I recently began medical school and really do not have the money to repay them all at once. I am completely overwhelmed with school and really would like to know what I can do and what my best options are. I was told that I should respond with an answer and a motion to compel arbitration. If possible I’d really appreciate any advice. Thank you. Sorry I’m rushing through this post...
Harry Seaward
Arbitration is going to be your best bet. If I'm not mistaken, tjmaxx uses Synchrony to back their credit cards, and Synchrony has one of the best arbitration agreements. You'll probably have to pay the $200 AAA filing fee once you your court grants the motion to compel arbitration, but Midland will dismiss and walk away at that point. https://www.creditinfocenter.com/community/topic/329436-arbitration-overview-and-strategy-2018-most-up-to-date-info/
Mariah
Ok, thank you. Now I have a really annoying question. Is there any site that can help guide me through accurately writing this type of letter to the court - my answer in response and motion to compel arbitration. Brotherskeeper
@Mariah Your county court website may have a fill-in answer form. I've included a link to Ashtabula's for you to view. The first link below has all the info you need to get started. MikeB35's threads are recent and Ohio. https://www.dinsmore.com/content/uploads/2017/06/responding20to20a20complaint20ohio203-578-2986.pdf http://www.ashtabulacounty.us/DocumentCenter/View/95/Instuctions-for-Preparing-and-Filing-an-Answer-to-a-Complaint?bidId=
fisthardcheese
In addition to the great links posted above, my link to the arbitration strategy below in my signature can help you understand how and why Midland will dismiss this case once you get the Court to grant your Motion to Compel Arbitration. Brotherskeeper
@Mariah Fellow Ohioan @Mloske fought hard and won 3 cases. Her threads are a great resource, showing the twists and turns that can arise with Midland:
MikeB35
Shortly after my above linked thread, my wife also fought Midland. She was successful by following in my footsteps. As you go through my thread, read all of it, as I did make mistakes in the beginning. I later was guided along the right path. I wish you luck , and if there is anything you need just tag me or PM me.
