MJGmuks Posted June 15, 2019 Report Share Posted June 15, 2019 Here is what happpend, ti started 2 months ago. 1. I got a summon and complaint. 2. I filled a response. 3. I got a court date a month ago. 4. I just had a surgery and needed couple of weeks to recover therefore I requested a reschedule. 5. 3 days ago I received a letter in the mail from the attorneys who Midland hired. It states. "Plaintiff requests that the court strike the motion of summary judgement hearing from the docket that was scheduled......Court date.... What does this mean? WhoCares1000 Posted June 16, 2019 Report Share Posted June 16, 2019 Could be one of 2 things: I think Washington does pocket docket and they were running on autopilot in doing motions for summary judgement because most people do not answer. In other words, they go caught off guard When you did not show up for the hearing, they filed a motion for summary judgement not knowing that you had already moved to continue the case due to your surgery I don't think they dismissed, I think they just realized that they will have to argue this case rather than get a summary judgement.
