does this qualify for DV?

Recommended Posts

Hi I sent Midland credit management a DV request. they replied me with this a few weeks later. just application. no amount owed, nothing. is it good enough for DV? should I request again for more info? because I really not sure when was my last payment on this debt. it is not on my CR.

In CA, the SOL is 4 year correct? so if my last payment was more than 4 years. that mean they cant sue me?

thank you for your time.

The function of sending a DV is to set a violation trap for the debt collector. To that end, what they sent would probably pass the smell test.

What did your DV letter ask for? If all you did was "dispute" the debt, what they sent establishes that you did in fact open a Chase account. If you disputed something specific, like an amount owed or date of last payment, you can ask them to try again, but they aren't obligated to do anything more than "obtain verification", and send it to you. Which, legally they did.

I have to respectfully disagree.   If the OP sent a timely DV requesting validation, what was sent to him in response does not show the amount claimed by the creditor.

At the minimum, "verification of a debt involves nothing more than the debt collector confirming in writing that the amount being demanded is what the creditor is claiming is owed."  Clark v. Capital Credit & Collection Servs., Inc., 460 F.3d 1162, 1173-74 (9th Cir. 2006).
