trudey Posted November 23, 2019 Report Share Posted November 23, 2019 After they got a default judgment against me, I have a creditor that sent me a SUBP-025 (California form) saying they want to find out about my employment and banking information. I am a party to the case, so I'm not sure the form SUBP-025 is appropriate for me. It is a subpoena for me to send documents over to them. If I don't have the original credit card applications that I used to get the credit card, how can I send the documents to them? Any idea how I should go about doing this? Thank you. Looking at an online copy of the form it gives someone served with it the option to object to the production if they are NOT a party to the case. You are a party so that would not be available to you. They are doing a debtor's exam to collect on the judgment. You are required to respond to this. Failure to do so could result in arrest for contempt of court. I would immediately consult legal aid (if you qualify) or call a consumer attorney to ensure there is no option to get the judgment vacated. Otherwise you need to get what the court has asked for or have a valid legal basis for objecting. You cannot just ignore it without serious consequences. At this stage they most likely do not want or need the card agreement or an application. They already have a judgment. Usually they want the last 6-12 months of bank statements for all accounts you have. The same for pay stubs for that time period. A list of assets etc. What exactly did they ask for?
