Kelisj
I'm being sued by Second Round LLC for Comenity bank. How do I respond to the letter and should try the arbitration process?
Harry Seaward
It seems that Second Round is a debt collection agency/lawfirm. If Comenity is named as the Plaintiff in the complaint you were served, it means they still own the debt. If that's the case, it's doubtful arbitration will be much help. I think that may depend on the amount of the debt.

Possibly, but it has more to do with Comenity's policy regarding pursuing consumer initiated collection actions in arbitration. IIRC, there was a gal here 6 or so months ago that tried arb against Comenity. Not sure what the outcome was.
