Charge off removal

The only way the 7-year reporting period would change is if the OP brought the account back to a current status and then defaulted again.   Payments that do not bring the account back to a current status would have no effect on the DOFD.

Each account I have left on my credit report last payment was May 23rd, 2013.  So it is now over 7 years.  I have not paid anything on them.  I was working with a debt lawyer suing the pants off of debt collectors about 5 years ago and he advised me to never pay the debt, so I didn't.  I believe there are now 2 accounts left on my credit report showing "charged off" which were last paid 5/23/13.  

 

How long do the companies have to remove these listings from my credit report?  What are the repercussions if they don't remove in time?

In general, I think the courts have given CRAs a leeway of about 6 months to remove old stuff. Even if they don't, you have to dispute the old stuff with the CRAs before you can take them to court over reporting old information.

My personal experience is that they will remove the old stuff pretty quick themselves unless the debt collector put some information on the trade line in an effort to keep it on the report longer. That stuff, you can dispute right away.

So in your case, I would wait about 3 - 6 months and then check again to see if the trade lines have been removed. If they have not, I would dispute the trade line with the CRA as being old information that should fall off. If the dispute does not work, then you have the option of court to get the trade lines removed. I doubt it will get to court however.

Technically, the FCRA states that the 7-year period begins 180 days after the delinquency.   If you defaulted after May, 2013, they have until around November or December to remove it.  But, they may remove it sooner.   Sometimes a CRA will remove right at the 7-year point.

As if waiting 7 years wasn't enough, now I may have to wait another 6 months? Jeesh
