I hired an attorney with a good track record of getting these types of cases dismissed, and it was dismissed without prejudice. However, now I'm seeing that they've soft inquired on my credit report 4 times since the case was dismissed. Are they allowed to do that? They still own the debt and a dismissal without prejudice simply means the case was ended without a decision rendered by the judge and Midland is free to sue you again if they so wish. My mistake -- I meant to say they dismissed WITH prejudice, so they can't sue me over that debt again. So is it legal for them to run these soft inquiries? Generally, voluntarily DWP doesn't mean they can't still try to collect - only that they can't sue. It's effectively the same thing as a debt where the SOL has expired. BakerFan Posted June 11, 2020 Author Report Share Posted June 11, 2020 Harry, we had a settlement agreement but there's a Confidentiality clause so I can't discuss it. I didn't think debt collectors could inquire on accounts they can't do anything with, if that makes sense. Midland was removed from my credit report last year, so I just don't understand why it's legal for them to do soft inquiries. As long as someone tells me it's legal, fine, I'll accept that and move on. But if they're not supposed to be doing this, I want it stopped. Yes, one, with the other typical collector we see a lot. But I won an MTC arbitration with them and things went kind of haywire, in that my credit report says one thing but I have paperwork that says something else. (Sorry I'm not giving a lot of details here; I'm trying to lay low until my SOL runs out -- you can message me if you want.) So the other collector is on my credit report, but they're reporting inaccurate info. Do you think that's why Midland is doing these soft pulls then? Soft pulls are allowed to review collection accounts. For instance, a JDB might review accounts that it is considering purchasing.
