ReneLee
I am being sued by PRA for a Paypal(Citibank) account. I have my hearing coming up and noticed something that I am not sure how to handle. I already filed my MTC and went the necessary route for arbitration. I was all set to go the arbitration route but I also noticed that the last 4 digits of the account number that PRA listed do not match the account number I had. My question is should I point this out or not? I haven't seen this happen to anyone else so I'm not sure how to proceed. I'm not sure if pointing out that they in fact have the wrong information will show they do not have the right to collect the debt or if I will just shoot myself in the foot because wouldn't this also nullify my arbitration clause since I'm saying the account I submitted if for does not match they one they are suing me for? ANY ADVICE WOULD BE GREATLY APPRECIATED!!!
BackFromTheDebt
Is this in a small claims court? I ask because Citi has an exclusion for arbitration for small claims cases.
ReneLee
Yes. But I have the credit card clause from that time and it does not have any exclusions. I'm honestly not sure where they came up with Citi bank or the last 4 digits of the account number because neither of these are accurate. Not only does the account number not match but even PRA has sent me notices in the past that list Synchrony which it who it was actually through. I don't know where they got the Citibank all of sudden. It kind of seems like they just threw some random info on there and hoped I wouldn't notice or respond.
