kay07
Hello everyone. I have been sued by Portfolio Recovery Associates and was served the papers on Monday 8/31/2020 and I have 14 days to respond. I was not sure what all information that would be needed, so I have attached all of the documents that I was served. Thank you all in advance! alwayswinning36
When is the last time you paid a payment on the account? The bill of sale they provided appears to have been in 2019.
kay07
2018 actually. I had some personal issues and to be honest I sort of forgot about this one. I had some other cards that I have gotten straight with and I am doing the best that I can but there is no way that I can pay all of that plus court costs right now. I would not reach out to them about settling anything or anything like that until you at least file an answer with the court. After I filed the answer, I would reach out to them and try to work something out, if I wanted to.Is that what you'd like to do, is work it out with them to pay it? Impress
Arbitration is a strategy also. OC was Synchrocy which I've read has the best arbitration agreement. Get a copy if you don't have one already and read @fisthardcheese's thread on arbitration here.
fisthardcheese
You can beat them and pay $0 to make this go away permanantly, but it will require some work, a lot of reading here to learn how, and most likely a court visit. But it is very possible. The thread linked above is the place to start at. Your very first step is to file an Answer with the court which denies all of their allegations.
