I received a summons from Midland Credit for 6k for a debt with PayPal credit. The debt was for a training/coaching product and the required additional spending to support the training. The whole thing was a huge scam and money grab. It took awhile to realize that the "trainers" were really full of bs and just teasing everyone along getting them to spend more and more money while they made hidden percentages off the efforts of really inexperienced students like myself. It was actually a pretty sophisticated setup. Once I realized I and no one else was going to receive MANY of the things promised, I contacted them for a refund. They told me it was too late. I then contacted PayPal credit and let them know what was going on. They actually used PayPal credit as a tactic to get more people in who couldn't afford the upfront fees because it was a payment system. PayPal refused to give me a chargeback. It was literally impossible for me to make the payments after none of the promised results and all the extra non-disclosed but required spending. I have pages of scam complaints from other people and direct contact with other people who were able to get chargebacks from their credit card companies. You need to take everything you agreed to when you joined and have a lawyer review it. While I agree it is likely a scam it is also possible they had their lawyers draw up air tight contracts that they get "trainers" to agree to when they sign on. Without knowing all the details in the digital contract(s) you agreed to it is not possible to state whether this would be a valid defense. The other problem is you did agree to these charges. Buyers remorse is not necessarily a defense. Just because others got a refund from their CC companies doesn't mean you were entitled to one. I received a summons around 8/1, sent it to an attorney friend who said I should just call them and settle... I was afraid to call so I didn't. Then received a letter 8/20 (that was dated 8/13) from Midland Credit Management that says "A Lawsuit has been Filed Against You" saying that it's not too late, call us to discuss your options and that if they "are unable to resolve the matter voluntarily, they may seek a judgement against me." I'm lost as to what to do next, afraid to call, afraid not to call, timeline is freaking me out. Summons Info: Midland Credit Mangement Inc. PO BOX 1628, Warren, MI 48090 Boxes checked for Civil Case: There is no other pending or resolved civil action arising out of the sam transaction or occurrence as alleged in the complaint. The complaint says that Midland owns it, has not been able to get a response from me despite best efforts, outlines details of the OC - Synchrony Bank previously known as GE Capital Retail Bank Attachments to complaint: Purchase of account Affidavit, Statement of Account and Bill of Sale/Conveyance/assignment of all rights, Certificate of Conformity, Account Statements, Account info. First you need to find out if they filed for a default judgment. If you didn't file an answer timely you may already be up a creek and forced to settle. Follow what @Brotherskeeper suggests.
