Nona 0
Filed my MTC on 10/12/20 but court never sent me court date hearing. I called them a week later and the clerk told me my court date is on 11/10/20, which is less than 26 days (the appropriate time frame to inform the plaintiff in CA courts) notice. But I sent the notice to the attorney anyway. Now they’ve sent a letter saying it was too short of a notice and they do not have enough time to prepare for the hearing. So what the heck do I do now? The clerk that processed my MTC claims that they sent me a copy of my stamped MTC with court date confirmation via email but I never received it!!! And another clerk said I can either go to the hearing and explain to them that I never received the confirmation and hope that the judge is not having a bad day. Or I can just refile my MTC (pay another $60 to file) for a new court hearing date. is it okay to have an MTC. hearing date schedule for after the actual court hearing date? Any suggestions on what I should do?
