LAClipper Posted February 2, 2021 Report Share Posted February 2, 2021 Hello Everyone, Just found out my partner has an old default judgement from a letter/forms we received from the Attorney Hunt and Enriques representing Portfolio Recovery and Associates. The letter includes an application to renew the judgment and the proof of service . The Default Judgement by the Clerk at the Court was entered on 03/20/2011 in Los Angeles, CA. I looked at the original court case and this is what shows on the website: Case Number: " " PORTFOLIO RECOVERY ASSOCIATES LLC VS " " Filing Courthouse: Stanley Mosk Courthouse Filing Date: 12/20/2010 Case Type: COLLECTIONS CASE (Limited Jurisdiction) Status: Disposed So does Disposed mean the case has been closed? I'm wondering if the Attorney is trying to pull a fast one on us because the forms that were mailed do not have any seals, stamps from the courthouse nor do they have any signatures from the clerk at the courthouse. If this is the first notice of this default judgment your partner has a slim chance of getting the judgment set aside for improper service. If that happens there is another chance the SOL is expired and they can no longer pursue this. This is NOT a DIY project. Consult a lawyer now.
