card agreement doesn’t have arbitration clause?

Probably not. 
 

I say probably because there is a small chance you will be able to find a different  version of the agreement with an arbitration provision.  Of course that depends on the OC.

Who is the creditor for the card?  Capital One removed arbitration as an option over a decade ago.  Several others have it in there but specifically put in a carve out for debt cases and/or small claims court cases.
