Citibank/Resurgent/PYOD LLC

I received a letter from Resurgent Capital Services saying that I owed money to PYOD LLC and gave me the account number and original creditor which was listed as Citibank. I replied to the original letter saying that I disputed the debt, had no idea what this debt is, and that I wanted them to validate the debt at the suggestion of various forum posts. I recently received another letter from them showing the account summary that they have, which is just the basic info that was in the first letter (name, account #, creditor, etc) with the addition of the charge off date which was 9/30/2011. I'm not 100% sure if it's past the SoL since from my research, Kentucky seems to be somewhat ambiguous about when that cutoff is. Everything they've sent also includes the line "The law limits how long you can be sued for debt. Because of the age of your debt, PYOD LLC cannot sue you for it, and PYOD LLC cannot report it to any credit reporting agency.

 

So basically at this point my question is what should I do next? I've seen various forum posts about an FOAD letter telling them to cease communication but once again I'm not sure if that's the correct move. Any advice would be greatly appreciated! Thanks!

Since they stated that the debt is too old for you to be sued or for it to be reported to the CRAs, you can either ignore them or send a cease and desist communication letter.  Just be sure and save the letter that states you can’t be sued.

That was my gut reaction, but being the over-analyzer that I am, I started to think maybe that meant PYOD LLC couldn't do anything, but Resurgent could. Is that a possibility?

No 

Legally, if they sue you, you can:

1. get the case dismissed with prejudice for SOL

2. sue them for FDCPA violations.  Possible state violations as well. 
 

They aren’t that foolish. 
 

Save the letter.  If you seen a cease and desist letter, send it CMRRR and save a copy in case they contact you again. If they do, you can sue them.
