nerdiegirlie
Going against Midland, (synchrony/PayPal) and looking for the arb agreement. When opened was funded by Comenity Capital and I have that arb agreement. Before default, was switched to Synchrony. I cannot find the agreement for just the credit line, not the credit cards. looking for any help finding this? Would greatly appreciate any guidance! BackFromTheDebt
Does the original arbitration agreement have a survivability clause or a sever ability clause? If it has a clause saying the arbitration provision outlasts the rest of the agreement, you have the arbitration provision you need.
nerdiegirlie
Thank you! I’ll look at it more closely this evening. I have found subsequent synchrony agreements and they all amount to the same process. I do see survivability in the synchrony, but the comenity kind of leaves room for amendments. BackFromTheDebt
Then use the Synchrony for your MTC. Good luck !

HERE ARE PAYPAL 9/2020 AND 9/2019 Other years and quarters are here in zip files https://www.consumerfinance.gov/credit-cards/agreements/ In my suit I used the one that corresponded to the monthly statement they provided with complaint (warrant in debt in VA).
