I want to take care of this and move on. Problem is they are stingy and wont budge on 10% off. They are intent to sue so not surprised. Do they look you up for active/closed cases before filing? I am well prepared when they do file suit... just curious if they see how the last two cases progressed and dismissed, if that's enough for them to not follow through. If they won't budge off 10% I would not try to negotiate with them further. If you sound desperate to get this resolved, they will figure you have some reason to clean up your credit, like looking to buy a house. So they will be less likely to settle on favorable terms and just file suit. You have been through 2 previous cases, so you know how to beat them. I doubt they will review past cases before deciding on what to do with this one. In fact, I have a feeling most of those decisions are done my computer rather than any real human and a real human only gets involved when they are needed for something. That is why when you arrive at court, the opposing attorney is a local rental attorney who got the case the night before and usually has no clue what is really going on unless it is straight forward. "We are proceeding with an evaluation of your account and are considering forwarding this account to an attorney in your state for possible litigation". If Ican just get it down to 50% lump sump with MCM, I'd pay it and avoid this nonsense. Last week, I settled with Chase. I paid $450 on a $5100 debt. I talked to no one to get the deal. They kept sending offers by mail and every offer the price kept going down. In their offer, the $450 would consider the entire balance settled and further collection efforts would stop. Butterfly1 Posted August 10, 2021 Report Share Posted August 10, 2021 @dontwearmasks I'm fighting MCM too. I go to court next Thursday the 19th. They wouldn't budge for me as well and so apparently they are suing me. However this is my 1st court case. I've filed motion to compel arbitration the end of June. This paat Friday, I received a consent judgment requesting for me to sign to avoid court proceedings. Along with that, they have also filed motion to stay pending arbitration. They sent me 2 pre legal letters so far and honesty don’t know what to do. I read about arbitration but does it really work? The amount owed is around $14,000. How should i proceed? Should i send something about arbitration or should i wait to go to court? Also made the mistake where i did speak to them and they are manipulative, threatening, and use foul language - wrote down everything just in case i need it.
