bff Posted August 3, 2021 Report Posted August 3, 2021 Little known in here, is the fact that a Pro Se in california can get PAID to represent themselves if they win a dismissal. So build a strong case, and catch them unprepared. If you get a dismissal you can make a motion for your costs AND lost wages. And thats not just lost wages for showing up..but for 'preparing for trial'...in other words all the months you spent fighting it CCP § 581.5 https://codes.findlaw.com/ca/code-of-civil-procedure/ccp-sect-581-5.html In a case involving consumer debt, as defined in Section 1788.2 of the Civil Code , and as regulated under Title 1.6C.5 (commencing with Section 1788.50 ) of Part 4 of Division 3 of the Civil Code, if the defendant debtor appears for trial on the scheduled trial date, and the plaintiff debt buyer either fails to appear or is not prepared to proceed to trial, and the court does not find a good cause for continuance, the court may, in its discretion, dismiss the action with or without prejudice. Notwithstanding any other law, in this instance, the court may award the defendant debtor's costs of preparing for trial, including, but not limited to, lost wages and transportation expenses. "California legislation provides that if a consumer appears for trial, and the debt buyer either fails to appear or is unprepared for trial, the court may dismiss the action. In that case, the court may award the debtor’s costs of preparing for trial, including lost wages and transportation expenses." Quote
