HHJTexas Posted August 15, 2021 Report Posted August 15, 2021 Sued by Citi / Unifund fo 50K in Texas. Completed initial round of discovery. They have BOS from Citi, but no Business Records AFF. They do have statements, but its a crap shot if judge will allow based on foundation/Hearsay. Yes, plenty of case law, but judge has discretion. Only Affidavit in from Unifund. Trial is set for Nov 1. We've have had some settlement notations and they have come down significantly. I've set aside a figure I'm willing to pay and have a nice offer on the table that I'm willing to accept. I was going to accept, but on the condition they stop reporting to Credit Bureaus. I just checked all major bureaus and they are actually not reporting right now ( kinda weird). Even weirder, the original Citibank account is not reporting. So, Should I add a condition that they "not report" or just not point it out at all? Suggestions on how to proceed? Quote
Bulldoger Posted August 16, 2021 Report Posted August 16, 2021 For what it's worth. When my case with JDB went to court both OC and JDB trade lines were removed it's common I hear. In my settlement I stipulated they would not report the collection as that's all I thought they had control over. But none of the trade lines have returned. Quote
HHJTexas Posted August 16, 2021 Author Report Posted August 16, 2021 Just an FYI. I had a previous battle with a JDB, Rausch. Made it to trial.. They never submitted evidence and didn't show up to court (I did). I explained to the judge they never sent any evidence and actually tried too have the case delayed (wasn't approved). They knew about it and decided not to show up. I convinced the judge to dismiss w/ Prejudice. A few weeks later they tried to reinstate the case saying they had mis calendared it, but it was never acted upon. However, they are still. reporting on credit bureaus. I'm trying to get it removed via dispute with credit bureaus. Any suggestions to help my case to get it removed? Quote

If the court had ruled on the merits you didn't owe the money you could have it removed. Their failure to show up unfortunately is not enough from the bureau standpoint to do so. The JDB's last quiver in their arsenal is reporting to the bitter end when their lawyers screw up that bad. Quote
