WAState Defendant
I have an upcoming court case with a law firm representing Midland and I am looking into trying arbitration. The OC is CapitalOne and I opened the account end of 2013. Does anyone know if they had an arbitration clause back then? If so, where can I find it? Thanks! BackFromTheDebt
No. It did not. A Google search reveals they took it out a few years earlier.

You cannot compel them to do something that is not part of the terms and conditions of the account. You will have to either settle, defend the suit or file BK.
