HaplessHoper Posted December 6, 2021 Report Posted December 6, 2021 I am concerned with recent activity regarding a prior personal loan. The loan defaulted during a financial setback and it may have been sold and now that party could be taking action. The loan was with Best Egg which appears to be with Cross River Bank. A month after funding, ownership was changed to Marlette Funding Trust. I do not have a copy of the promissory note or loan agreement (I did but cannot find). How can I obtain these documents? For that matter, how could I obtain a copy of any loan agreement or promissory note? I would think a lender would be required to provide a copy (by law) but are there cirmstances where they do not have to do this? I am searching for this documentation to verify an arbitration clause. I see that these parties do use them with other financial instruments (credit cards, etc.) but not having the actual loan docs, I want to be certian about this instrument. Reading about arbitration on your site, there seems to be recommendation that you use this information in a MTC and related affidavit, so to do that, I would have to have the evidence. Appreciate any advice. (I did check CFPB but they only had a Visa credit card agreement wiht CRB; no note or loan agreement.) thank you. Quote
