Arbitration terminology

Does this mean arbitration is off the table as an option?

Could you please post the whole paragraph?  Sometimes when they say “requirement”, it doesn’t mean arbitration is excluded.  It just means it’s not required.  “Required” and “excluded” are 2 different terms.
