Wondering if some one can give me pointers how to proceed? I’ve never had to do that, so I’d recommend seeing if your clerk of court can give you some pointers. Otherwise, I’m not sure it would be titled “compel discovery”. That usually means to order the other party to comply. The rule says you’re requesting leave of court to conduct discovery. It might be more along the lines of a Motion for Leave to Conduct Discovery or Defendant’s Request for Leave to Conduct Discovery and citing the rule. Something like that.
