Mortgage foreclosure reported but no foreclosure

Recommended Posts

I got a VA mortgage in 2018. I have made payments on time since. Last july my mortgage servicer, Wintrust Residential, sent me a foreclosure notice. I immediately called them. Seems they had lost four monthly payments. These payments were recovered by my bank and I paid them to Wintrust. Right in the middle of resolving this issue my servicing company was changed to Mt. Cooper. Wintrust residential has not change my credit report. The report shows 4 months late foreclosure initiated. Wintrusr residental will not change it. They have told TU that the info is correct....lost as to what to do.

First off. If your user name refers to service in the USMC, thank you for your service.  My late grandfather was a First Lt. in the Battle of Okinawa.  He was the intelligence officer for a group of USMC pilots on a small carrier. My grandfather was the “old man” at almost 36 when the head pilot, a colonel, was 29.  My grandfather was extremely protective of “his” pilots, and when I was young he drummed it into my head that Marine pilots were the very best; at least better than the Navy pilots.

So my grandfather, after whom I was named, would want me to help out a Marine pilot.

There are some people on this forum who are more familiar with credit reporting issues than I am.  I will do what I can and hope the more knowledge ones come into this thread.

The first thing we need to know to help you — did you dispute this with TU?

Also, is this on your other credit reports?  You need to dispute with all of them.

Did this place give false information to TU?  If so, that could be a willful violation of the FCRA, and you need to find an attorney to sue them.

Please give further information and I hope a better expert chimes in

I am not following this part.  What do you mean they "lost" four payments?  Were those payments auto-drafted?  What specifically happened with this?

What  is the reason they give you?  If the payments got "lost" in the digital system between your bank and them then this information may be accurate.  If it is entirely on their end you have a different course of action to take.

I had proof from my bank that the payments were sent and paid. I showed them this info from my bank, Wuntrust located one payment and my bank recovered two of them,,,and I paid them. Wintrust told me they could not locate any payments until my bank got involved. They received their money.
TU only response was creditor verified it is correct.

To set the record straight,,,I was in the Marine corps, I was not a pilot,,,,I had a private pilots license, but I do not fly, I have severe migraines due to injuries in the military so I cannot fly. I retired in 2006

That makes a big difference.  My guess is you are dealing with lower level CSRs.  It is time to find out who the CEO is for Wintrust and send a well worded letter certified mail return receipt outlining the facts.  No payments were missed on your end and they are falsely reporting a foreclosure when the error(s) were theirs.  It needs to be removed from your bureau report(s) immediately.  If they refuse then you hire a consumer lawyer and sue the pants off them.
