I was sued by an attorney firm representing Capital One after I sent the debt validation letter. I received the complaint and answered. Now they are proceeding with a Motion for Summary Judgement. They did supply the statements but no signed contract. Does anyone have any ideas?

What kind of signed contract are you looking for?  Because the creditor is Capital One, I'm assuming this involves a credit card.  User agreements for credit cards usually contain standard language that says use of the card constitutes agreement of the terms.

If you don't have any valid defenses against the debt they claim you owe, there's really nothing you can do.  The Court will likely grant their MSJ.
