  1. I give up trying to force an outcome here. Thanks again for all your help. I'm deleting my account and leaving this message board.
  2. Thank you for your concern. I am no longer in that state of mind and have thankfully overcome that period of my life. I was merely stating what I had to go through in order to still be here today. But thank you for your concern and i'm sorry to hear about what happened with your kid; glad he/she is alright and also pulled through.
  3. Thanks for pointing this out. If I could go back and start fresh, I would. Initially I just wanted to stall the suit until I was able to find proper representation... but things ended up getting worse for me (financially) and that idea went out the window.
  4. I just looked through my personal files and cannot find the original. So yes will have to go get a copy from the clerks office. Thank you for pointing that out.
  5. Yes I just double checked and went back to the docket to re-download. Only 3 pages total in the Plaintiff's motion to strike.
  6. They were referring to my first affirmative defense... notice the #1. right under that phrase. 😩
  7. That was literally it. It was a 9 part motion to strike. The last page was just the certificate of service.
  8. This one hurt. You don't know my circumstances nor what i've been through in that this "debt" is following me around. Let's just say i'm still here on this planet by the grace of god. I've been left with nothing and having considered taking my own life as a way to overcome all of the challenges that i've had to face. But i've decided to fight this out, and I came here as a last ditch effort to get help. The circumstances of my case is not one of me "stiffing" a credit card company out of money owed, instead I was put into businesses that I got stiffed out of and as a result don't even qualify for a chapter 7. So my only option here is to fight with the little ammo that I've got. I don't have a penny to my name so hiring adequate representation has been out of the question. Don't judge people... you don't know what they're going through or what they've gone through. Chances are if they're here (in this forum), they're most likely in a shitty situation and needing a helping hand.
  9. I am sorry you feel that way. I do thank you for sharing and for being here to help others that need the help.
  10. Sorry, I think there was some confusion... I wasn't refusing. Didn't know that would make any difference this far along. Affirmative defenses.pdf Amex motion to strike affirmative defenses.pdf
  11. Thanks for your contribution. I've seen plenty of people here in this forum helping others create defenses against Amex, yet it seems like on my case all i've encountered is "just give up, they've already won."
  12. Thank you for your replies. In my post, I did request HELP in preparing a defense. I've already consulted with attorney's. I'm here because I exhausted my other options. This is a BUSINESS credit card that was personally guaranteed.
