ImaBird Posted February 1, 2008 Report Posted February 1, 2008 These are the last 2 activities on my judgment history... what do they mean?_______________________________03/26/2007 Garnishment ret'd - no record of Defendant (JP Morgan Chase Bank) 0.00 0.00 03/26/2007 Garnishment ret'd - located no deposit accts (JP Morgan Chase Bank) $0.00 $0.00 ________________________________They were granted permission to garnish me, but they looked at the wrong bank... is this just saying that they didn't find me? How long do they have to garnish me? Could they do it in 10 years if they find out where I bank or work?
sgip2000 Posted February 1, 2008 Report Posted February 1, 2008 You are correct. They tried to garnish but the bank told them you didn't have any accounts. If the find your true bank, they can go back to the court and request another writ for the proper bank. Just gotta stay one step ahead until the judgment is expired.
Recovering Attorney Posted February 1, 2008 Report Posted February 1, 2008 Just mean they sent an execution to Chase and it was returned empty as you had no accounts there. They have however long your state allows someone to enforce a judgement
ImaBird Posted February 2, 2008 Author Report Posted February 2, 2008 They have 21 years in Ohio. They can renew the judgment every 5 years.sgip2000, do they have to go back to court to get a writ to garnish my true account? Will I know about it before they do it?Can I DV them still, or is that a bad idea?Thank you for all your help.
one who knows Posted February 2, 2008 Report Posted February 2, 2008 there is no point in sending a dv to them at this point,a jdgmnt has been entered against you. in the minds of the jdgmnt creditor the debt was proven to be legit by the court when the jdgmnt was entered.
ImaBird Posted February 2, 2008 Author Report Posted February 2, 2008 So pretty much I have to pay it? And they won't be willing to settle for less? Oy... this is going to be fun... where to start...
ImaBird Posted February 3, 2008 Author Report Posted February 3, 2008 Oh, yeah, does anybody know if, when the creditor requests a writ to garnish another account, do they have to notify the debtor?

sgip2000 Posted February 3, 2008 Report Posted February 3, 2008 sgip2000, do they have to go back to court to get a writ to garnish my true account? Not sure about every state, but they do in Oregon.
one who knows Posted February 3, 2008 Report Posted February 3, 2008 I would check the rules of court for ohio to find out if you have to be noticed about an attempt to levy on your bank acct. in new jersey most people don't find out about a bank levy until they are sent a notice by the bank and court officer. also with regard to any type of bank levy,if any of the funds in your acct are from the fed goverment(ssi) then those funds can't be levied, although you will have to provide proof to the atty for those funds to be released. For wage garnishment as well, you are only noticed after your job has rcvd the wex from the ct officer.
ImaBird Posted February 3, 2008 Author Report Posted February 3, 2008 Well, according the my local municipal court website, they were granted access to my bank account, but not my personal earnings.I believe it was listed as "monies, property, credits, but not personal earnings."The thing that pi$$es me off is that the money I put in my bank account IS my personal earnings... oy...Anyway, I have another bank account that I opened a couple of years ago under an EIN for a sole proprietorship I worked on the side... I'm going to be using it from now on.BUT, I really need to get rid of this... I'm trying to buy a home. I'm just afraid of offering a settlement, because that will just make them come after me harder... but I don't have the cash for the whole thing... it's almost $3K!
