Cell phone ?, Sprint PCS, collections

I had a sprint PCS account I closed in 2002. I moved to an area they don't cover, with even roaming.

Whtat's the SOL on cell phone contracts? Their CS told me I wasn't up for an ETF since they coudln't provide service where I now live.

Collection agency (Calvary) claims the date assigned was 12/02, though I question that date as well

I have DV'd Calvary last Monday so I'm waiting but not very patiently on this one.

Calavryv must have bought a bundle of old sprint accounts and are using Dec 2004 as the start date. I'm going to DV them, and see what happens. Also Sprint has listed as an account. This account is really old, maybe 4 to 5 years.Just thought I would let yopu know. Also Sprint just appeared yesterday and Calvary today.Haven;t they both reaged??/ Dec 2004??What the $#%&.

From the best I can see of what is hapening here, Sprint isn't really showing up, it's masked..... or spoofed somehow on transunion anyway. THough TU said yesterday he didn't see any Calvary anything, or sprint, but sure enough it was on my creditkeeper this morning. I think Equifax is reporting from Calvary Investments, LLC and TU is showing 11 sprint something, but has no visible acct numbers or anything. Fortunantly, EQ showed me the account number they had, I'm waiting on my DV, but I've since also fille complaints everywhere, perhaps if enough of us complain all at once someone will listen. I filled with ORegon department of Comerce, AG For OR, AZ, and NY, filed BBB listing, and complaint with Sprint, and a few others, I've had other things in the past go to collections, some that were mistakes, including this one from Sprint. NCO mind you went away with a simple DV I didn't even know to send CMRR the first time. Hadn't heard anything from anybody for some time. I'd finally gotten to a point where all my mistakes from 96 - 98 (Divorce) was finally coming off, down to 2 left on EX and none but an old PG&E bill I never got the bill when I moved to ORegon. Then these bastages come up and slam me with this... yea, I pretty much jumped on the deep end here, but honestly of all the shady collectors I've delt with over the years these guys make them look nice.

DV them, but file complaint right away, that company is bad enough we don't want to even deal with them . Who knows maybe some money will ocome of this, I'm in for a class action right now ! if we get enough SPCS customers maybe class action against them?

I'm not nomally litigious, but I've had it this time :) 8)

OK, so EQ shows new york address for Calvary Investments, Transuinion shows Calvary Portfolio svcs, in Tempe AZ ??? I sent DV to the first one in NY, do I need o send copies to arizona to ? or do their offices actually know what's going on ?

Today I received their DUN letter, from Tempe AZ.. So I'm guessing I need to DV them in AZ too? do I get that right?

Hey jojo, I know exactly what you're going through with these guys, I'm having the same problem, i.e., Cavalry on Eq, 11 Sprint PCS on TU, and to top it off, Sprint PCS is also listed again on TU under just plain old Sprint PCS. To answer your question it certainly wouldn't hurt to go ahead and DV the AZ address, too.

Here's a timeline of how mine has gone so far:

October 2004, Disputed Sprint PCS and their collection agency, NCO with the CRA's

November 2004, Sprint PCS listed on TU as disputed, NCO informs me that they have not received validation from Sprint PCS and are deleting the listing.

Jan, 2005, Noticed Sprint PCS listed on TU as 11 Sprint PCS and Sprint PCS. Noticed Cavalry Investments listed on EQ for Sprint PCS, and noticed

NCO's collection was still showing up on EX.

Jan, 2005, Continued: Disputed NCO again, sent their "we're deleting" letter, and EX refuses to re-investigate. I called NCO and they had the listing deleted that day, believ eit or not.

Today,: Jan 15, 2005: Mailed DV to Cavalry and ITS letter to Sprint PCS world Headquarters telling them that so far, they owe me $4,000 in FCRA and FDCPA violations alone, and if they don't cease and desist all collection activity, I will sue them in Federal Court for those damages as well as defamation of charachter, headaches, sleeplesness, stress, performance decrease at work, etc... :twisted: I gave them 15 days...we'll see how it goes. NCO conatacted me in November of 2003, sent just a plain ole letter telling them the amount was wrong. Never heard anything from them again. They never listed on any of the CR's, they did pull an inq, but nothing else.

I suspect violations as well, and filed compliants right off with Cavalry. I was ticked when they reported "reported since 12/04" on eq and tu, it actually showed up on 1/8/05.... so FTC, AG for NY, AZ and OR> and BBB. But I have to admit, their DUN letter was one of the more pleasant ones I've seen so far... but ten this is the beginning of the mess.

I've also filled BBB complaint against SPRINT, and a complaint with the FTC on them as well. Probally jumped the gun here, but NCO couldn't validate and went away..... Now Sprint wants to come and play.

I myself have Calvary listed on my account for Dec 2004 for Sprint PCS.

Are they not suppose to contact you first, before putting in on your credit report? I am highly upset. Please someone explain.

I'm under the impression they are suposed to contact first....... I also take exception to the fact that TU lists it as 11 SPRINT PCS where EQ lists it as Calvary Investments.

There is also other reference on credit keeper that TU is listing it as Calvary Portfolio Services.

So what do i do at this point? Settle the debt to delete or dispute? And will they settle to delete. I am very upset about this. Could I have at least got a letter!!!!

I hear ya, I sent DV right off.... don't know how that will go, but we will see. And I agree, I wish I'd goten something first. NOw I supsect it will be hard to get rid of it, even if it isn't validated.... Which it shouldn't be, since Sprint told me I dind't have to pay an ETF since I moved to an area they couldn't provide service. Not even roaming her grrrr :twisted:

Thanks for responding. I think I am going to settle to delete, I am tired of playing with these collection agencies. Do any one of them have any compassion?

Another question for you: I pulled my reports from myfico.com and some things i had deleted with all 3 credit bureau are still on there. I am confused on why they are still there, when the credit bureau sent me a letter saying they were deleted. Even the inquiries were delete. Please explain I am confused!!!

Hmmm, I should think myfico pulls off the big three. I didn't know they kept the info...... you do know that myfico doesn't update right? I'd suggest a different monitoring service, I use www.mycreditkeeper for general purpose.... it has a fako score which is ok to track, but I wouldn't rely on it for a loan. The nice thing is it shows how things efect other things, and has decent monitoring. it's 9.99 a month, charged monthly. I also use equifax gold to monitor just my eq score too. all them have something like it, but credit keeper seems to suit my needs ok

Yes,

I just realize myfico does not update, that is alot of money only to pull one set of reports. But myfico isn't it the real scores??? that mortgage people see, or do they fluctuate as well. I going to try that website also, but i am still trying to figure out, why the deleted items myfico is still picking up, and on top of that my fico retrieve some things that isn't even on my hard copy credit reports!

What's up with that is the credit bureau reporting only half of the report or what!!!

Need help with this madness!!!!!

This creditkeeper looks the same as privacy guard. Is it? If so I have privacyguard, but I haven't gotten any updates on it. I am looking for a website that i can pull unlimited reports. Is there any such thing? I don't know, I am new at this whole process!!!

I think they are the same company, CK can pull unlimited once a day, I think the same is for PG. EQ's offering holds you to the 24hour period :(

I know you can few most recient on EX if you have a report number from them, and can see updates as often as you want...

order your EX report, get a report number you should be able to access most recent anytime you want

Everytime I pulled from Privacy Guard it has the same date of report so it is not updated. I called them the other day and they said They only update it once a month from the date I originally requested it. Is this So, Or am I just cliking on the wrong Que's, I don't know!!! :?:oops:

Hmm, not sure since I don't use PG. I know creditkeeper changes each day I pull it, and can compare the last month's worth of reports/fako scores.

What I just realize about Cavalry (SPrint) can't we dispute on the last date of activity, because on my report they are reporting as if it was just charge off 12/04? Isn't that a strategy?

really? mine shows date of 1st delequency as 12/02.... still wrong, but, .... the Calavary acount was assigned 12/04, reported since 12/04, date opened, 12/04...... UNPAID

So even if it is reported as saying 12/02 isn't that still inaccurate reporting when the debt was charged off earlier?

I'm not actually sure... I can' t remember when I closed my SPCS account. I know it was in 2002 sometime, I think..... but not certain, but I know I never had a cell phone bill that much, and I wasn't suposed to have to pay an ETF because SPCS isn't that great in Oregon, any more than 5 - 10 miles from the highway

I know where most of those charges can come from.

WIth Sprint if you don't officially close your account, and of course after the contract period, they will still charge you the monthy amount even though your phone is off. Because in actuality it is reporting at $476 but my bill is only $238 the rest is the monthly plan that i had, and my phone was already off :x:x

I had an old collections account from Sprint PCS originally filed in July 2002 written off my account by TU and EFAX last May 2004 because it could not be validated by either CRA.

Well, it seems as if Cavalry bought the debt from Sprint PCS, and then reported it to TU and EFax but without notifying me first. I recieved a letter from Cavalry on January 11, 2005 dated Jan 7, 2005 stating that I had 30 days from the date of the letter that I dispute the validity of

the debt, or they would assume it was valid. Too bad they had already reported it to TU & Efax before hand at the end of december (is that even legal?). Then, both TU and Efax added the "new" collection item to my credit report without notification, I guess they assumed it was new item, not just a recycled claim that previously deleted. The result, my credit score dropped by about 100 points on each report. The collection appears reported on my credit report as of 12/1/04 by equifax, and 12/23/04 by TU, and for some reason TU is listing the collection account under the old creditor Sprint PCS, not under Cavalry albeit with the new last action date of 12/23/04.

I thought the CRA's had to notify you in writing within 5 days of adding a previously deleted account to your report, which TU and Efax never did.

I want to clean this up as soon as possible, does any one know if I'd have any luck writing Cavalry and asking them to do a complete removal (its only $203.00) of the collection account if I pay in full?

Oh my this is scary

That is excatly what has happen to me, but unlike you I did not get any notification. The other collection agency that had it (NCO) I had deleted.

I pulled my report last night my scores has dropped about 75 across the board. I don't know if they will take a pay for delete, never had any dealings with them. But I did look them up in my state and they do not have a license to do collections here in NC, so maybe that is why I did not receive any notification. I

need to also pay to delete, I rather just do that then keep fighting with agencies buying them.

SInce you have paperwork with dates, you have a great chance to get them to delete it. I would play the concern and innocent customer who was mistreated, and have them send it to you in writing or email.

I am going to call them tommorrow, I think, I am not sure if I should even do that.

Anyone have any suggestions?????? :cry::cry:

not sure what you are getting at, you mean since I have proof the CRA's deleted the original collecetion item, then re-added the exact same account with out informing me?
