  1. Thanks!
  2. My husband has a tax lien that was paid the same year from 4/26/2001. As far as I understand, it should fall off 4/26/2008. Is it wiser to dispute it, or just let it fall off in a few months?
  3. I know this may not be very relevant, but I'm very curious... ... In Ohio, small claims court goes up to $3,000... ...Municipal court goes from $3,001 to $15,000... Since my judgment was for $2,729, why was I sued in municipal court?
  4. Great... this is what I have to look forward to... thanks for the warning!
  5. Okay, the broker told me that the buyer can make a concession in the contract for a judgment in the same way they can make a concession in teh contract to pay your closing costs for you.
  6. Ah, found it: https://www.oxpublishing.com/
  7. I just googled it and can't pinpoint what it is either... anyone?
  8. Well, I found a broker who is interested in speaking with me about doing this with an FHA 203(k) loan. I'll let you know how it goes!
  9. Here, I found it: "Evidenced by return receipt signed by any person, service of any process shall be by certified or express mail unless otherwise permitted by these rules." Doesn't sound very promising...
  10. Well, even if I was served improperly, and then get the judgment vacated, won't they just come after me again?
  11. Well, that's the tricky part. I have a UPS Store mailbox, and that is where I was served, even though I told the UPS Store that I DID NOT authorize them to sign for anything going to that mailbox. The only thing I ever received was a "notice to judgment debtor" telling me about my judgment... and I didn't even receive that until quite awhile after the date on it... ...that being the case, I don't suppose I'd have a leg to stand on even if I wanted to fight it...
  12. Sorry, but bumping this because I'd really like to know if I should respond or not...
  13. I heard that when trying to purchase a home, you can get a debt judgment rolled into closing to avoid a property lien... ...is this true? How about in an FHA loan?
  14. Yeah... one year ago... Palisades was granted access to my "monies, credits, and property, except for personal earnings..."
  15. Hey, thanks for the info... I'll keep that in mind...
  16. Thanks! That's the next thing I will do!
  17. I didn't, but should I have corrected the name and address on my CR before disputing anything else? My personal info on my CR is way off... they even have an AKA that is my husband's name!
  18. I'm not exactly following you. Please clarify?
  19. Well, I'm still a little confused about timely or untimely. I recieved the letter that I responded to on 12/29/07. I faxed my response on 1/15/08. I received this response on 1/29/08. The catch is, I doubt that this is the first letter I've received from them, even though I don't have any on file. I haven't been a good record keeper, pitching most collection letters I've received over the past couple of years, just because I didn't want to deal with them...
  20. On Jan 15, I fax a DV to Asset Acceptance. I went to my mailbox today, and found this form letter dated Jan 29. It says: Dear ImaBird, Information is requested to evaluate your account: Please initial the applicable choice below. ___ I intend to pay. ___ Payment in full enclosed. ___ I will pay on _________ (date). ___ Need to discuss. My phone number is (___)___-_____ ___ I admit responsibility, but am unable to pay at this time. This is an attempt to collect a debt and any information obtained will be used for that purpose. Sincerely, Debra Dixon - Phone: Toll Free 800-545-9931 Ext. 9709 Debt Collector I sent them the best DV letter I could muster, and that's all they've got? I know they can't think I'm that stupid after the letter I sent. And I know it's not just because 5 people are handling my account. Debra Dixon is the same lady I faxed the DV to!!! Oy. Has anyone else recieved on of these? Should I respond or ignore?
  21. I have an EIN for a sole proprietorship under my name. Wage garnishment is legal where I'm from; however, the the judgment exempted personal earnings. Here is how it was stated: "You are hereby notified that this court has issued an order in the above case in favor of Palisades Collection, LLC, the judgment creditor in this proceeding, directing that some of your money, property, or credits, other than personal earnings, now in possession of JP Morgan Chase Bank NA-Bank One, the garnishee in this proceeding, be used to satisfy your debt to the judgment creditor." Of course, I don't see how that works. They don't have permission to garnish my wages, but if I place my wages with this bank, then my personal earnings can be taken? Whatever. It's been over a year, and my presence has not been requested to attend an asset hearing, and if I do, they will be shocked (or maybe not) to learn that I own nothing but a car that's worth maybe $1,500. It is my understanding, at least in Ohio, that the court will not assist in collecting on the debt, and that my not cooperating is not, in fact, ignoring and order of the court... In Ohio, the SOL on judgment is 21 years, renewable every 5 years. Should I begin negotiating now, or later? How far do you think I can get with them after a year of not collecting?
  22. My plan is to take my name off of my husband's account, and deposit all of my money in an account opened under an EIN#... or not at all... THEN, I'll try to settle with them. It's been a year, and they haven't found me yet... and I haven't even been hiding!!! Should I wait it out longer, or go ahead and try it? Where should I start? $0.25 on the dollar? More or less?
  23. Well, I already have the judgment... ...is it unheard of for CAs to settle for less and/or negotiate on a judgment? I just need to get rid of this thing!
  24. ...not that I expect anything in the money biz to be fair, but... ...it doesn't seem right that if all the money in that account was earned by my husband, that they could freeze it and remove funds just because my name is on it...
