  1. I see what your problem is now. Personally I would talk to the court clerk or the prosecutor first BEFORE court. If possible not the same day. Try to explain and prove in a nice way you have tried to comply w/ the community service. Explain you want it recalled from the CA. Ask if you pay it now, and postpone the court date for say 30 days. In that 30 days DO your community service and go to court with that info..... Tough situation.......
  2. Fly, I am not sure about a municipality, it will depend on exactly what it is. Traffic ticket? surcharge? public utility? Im not trying to pry into your personal things but I do have some experience with the above. If youd like you can PM me and give me more detail.....
  3. Ok Im off to dipute the listing with the CRA,.....will update when the results are in.... Thanks.
  4. And yes if they are collecting on behalf of the OC and the OC still owns the debt then yes deal with the OC and the CA will go away. Just make sure that you get everything in writing. For instance, if you settle, make sure all debts will not be sold or transfered in the future.
  5. They are two different entries. If the OC deletes, it may be because they are just too lazy to answer, that does not affect the CA in any way. Remember, just because a TL is removed, it DOES NOT wipe the debt away. Getting a TL removed is most of the battle however it can spring back up at any time in the future. The only way to have a debt removed "permanently" before the 7.5 yrs is to settle it with a PFD. Perhaps I misinterpreted your question..... If you settle with the OC you have to make sure it is recalled from the CA. First, you will have to find out who actually owns the debt though, do that through a DV to the CA. Chances are your TL will say if it was sold.... If in fact it was sold, you will have to go to the CA and negotiate with them because the OC really hasn't anything to do with it anymore. Hopefully its been a while and the OC doesnt have records to back up their TL, so first dispute with the CRA about the OC, wait for the response and then ask for verification or an investigation to the OC. There is a good chance they will delete it after all of your disputing..... How'd I do moderator?
  6. The only one reporting is the CA.....
  7. Thank both of you for your help. I am going to follow your advice and see how it plays out.......
  8. I have an entry from HSBC that shows on my Experian report as: Date Major Delinquency First Reported: 11/2005 Directly below it is the CA ( Portfolio Recovery)entry for the same CC. Listed as: Date Major Delinquency First Reported: 10/2006 It also shows: Date Reported: 2/2008 (on the CA listing) FYI: I am in NC so I think the SOL is up at 3 yrs which is about 9 months away. Is this a violation? if so, how do I prove it?
  9. Thanks Nascar. Should I call the hospital back and ask when it was paid, then compare with the TL and see if it was in fact paid before collection? Or do you think I should just dispute as you said? What is the scenario you think will play out? By the way I think that you posting your cards and more importantly, what CRA was pulled is a helpful service, thanks.
  10. I have a paid medical TL for $60. I called the hospital and they couldnt find anything. So I called the CA, saying it wasnt mine the whole time and asked for the account number with the hospital. They gave me the acct number and I called the hospital back and lo and behold it is a PAID account from a few years ago. Here is my question, of course I want it removed, but since its paid I probably dont have much of a chance. So since the CA is reporting unpaid, and I know its paid how do I get them on a violation to threaten suit if not removed? or even parhaps make a few bucks to get'm in the wallet. I want to set a trap for them rather than alert them to correct it to a PAID collection. Did I confuse everyone or am I making sense? I am thinking I should wait a while to let the dust settle and DV them (which I shoulda done first). Then I will have a document that says they are falsely reporting......maybe call them and try to get them to screw up on a recorded call?
  11. I think you need to request an investigation with the OC. Verification is for the CA....... Thats my newbie 2 cents
  12. Are you using a 3-in-1 report? If so, try an "official" report. It should tell who it is on at least one of them....

    tax lein

I am going to contact the IRS on this issue. Via email of course, dont want to wake a sleeping dog. Ill post when I hear from them...
  14. IZ I like your letter I may borrow it and change some of the wording. Amerikaner, thats exactly what I was thinking, if they threw out the paperwork that I paid they cant prove it existed......we will see. I hope it works as well as IZ's By the way after a month and a half of work, I just got my FICO. I jumped on average 50-60 points for all 3 agencies! WOOOOHOOOO! 700 club, you better sharpen your pencils, cause here I come! Well, ok let me get to 650 first.......
  15. I DV'd ANFI regarding a phone bill of $146 from about 2-3 yrs ago. I also disputed with the CRA. Here is the letter ANFI sent me: We have received your dispute but are unable to confirm at this time. You have provided insufficient information to substantiate your claim. We will complete our investigation within 30 days of receipt of the following information: 1. The specific info you dispute 2. An explanantion ohaf the basis of your dispute 3. All supporting documentation to substantiate your claim. Examples may include but is not limited to, photocopy of DL, ID of your passport, proof of residency at the titme of service, receipts, etc. 4. A valid phone number to contact you What in the world does all of this mean? Please chime in and give me you thoughts as soon as possible. I think I want to fire off a nasty letter but perhaps I shouldn't????
  16. This thought of mine is kinda funny and ridiculous at the same time. BUT I think I'm onto something.... Make the CA PROVE I paid it. If they can't prove that I paid it (which is what they are reporting) then they have to delete it......I think. I am hoping once it's paid, essentially they throw the account and the info in the trash. Notice Im a Newbie and it is very possible I have no idea what I am talking about!
  17. Yes unfortunately I paid it and the attorney (I think a CA) for the OC keeps verifying when I dispute with the CRA. Of course I paid it Loooooonnnggg before I found this site. Perhaps Ill try a goodwill letter.......

    tax lein

I think JQ26 has made it as clear as possible, it is complicated. Especially when dealing with the IRS. I think that if it is not renewed in the 10 yr time limit it becomes unenforceable by way of a lien. As far as the installment default, I would think that it remains a "new" debt from the time of default but I have nothing to base this on........ Why not try to call the IRS and ask them without giving them your name? I think this is a common confusing issue that I have seen several posts on, one of which was mine. It sure would be great to have a tax collector chime in and lay it all out in laymens terms in regards to the various situations we find ourselves in.

    tax lein

I have a tax lien on my CR from 9/1992. It was marked paid on 12/03. It says on my TU report (the only one reporting) that it will be removed 11/2010. I have searched the internet and what I find is, it remains for 7 yrs after PAID. I dunno but I cant wait for it to go away..........
  20. I have a TL from a law firm representing a pest control co. it says PAID w/ date ('05). I have Dv'd them and they verify. Here is my thought, if I contest arguing I didnt pay it, do they have to prove I did? Here is what I am thinking, IF they cant prove I paid it, 1 of 2 things will happen. They will mark it unpaid and try to collect ($97) or they will delete it because they have since gotten rid of the info and can't prove their TL. Am I crazy or is this perhaps a tactic I could use to get it off my CR? I want them to prove the accuracy of their TL!
  21. Perhaps Im missing something, the more problems the better? Could you explain your thought process? maybe I'm missing somethin....
  22. I disputed every CA on my report at once, there were probably 7-10. I also disputed 3-4 cc's at the time I did the CA's..... I just got back results from Exp, with about 50% gone.........
  23. My 1st cap1 was opened around '00 and defaulted in '05 2nd cap1 opened in '02 defaulted in '05 I disputed with all 3 CRA's, I disputed as not mine first, they didnt buy it on the 1st cap1, but deleted my 2nd cap1. So I disputed again, telling them I had proof that the amount and the DOFD was incorrect. Viola! it was gone. I have no idea,.......I think I just got lucky. On the good side, Cap1 has only reported every 6 months or so. The bad news is, chances are it'll be re-reported...... I am battling right now on a cable bill from back in '02, I want it off now because I have 3 entries from the same co. but Im not getting anywhere. I sent a very nasty letter to Credit Management (Randel Phelps) and I am awaiting their response. BUT, it'll fall off soon anyway.... Sorry there was no "magic bullet" just try everything......
  24. Thanks for all of the encouragement fom everyone. Tryin4gr8credit, later tonight I'll post what they actually were (dates, amts, etc.) Most were way too easy,......
  25. I have to admit I started this thing out kinda going "through the motions", but I have a breath of fresh air right now. My deletes last night infused me with new vigour. Thanks to this forum and each of you, I know now there is a possibility of turning over a new leaf. I am going to await the results of some other disputes and DV's before I look to the wiser members for answers on the harder entries...... WOOHOO! Stay positive.....
