Won against Midland Funding Today

I just want to thank all of those who have taken the time to educate us about the process of being sued by junk debt buyers. After reading the information on this website I was able to answer the summons and the list of interrogatories. My pre-trial was today and trial scheduled for next week. As I was waiting for my turn I watched 3 people just admit to this debt. I denied the debt, did not admit to anything and when I asked why they have not answered any of my requests for proof of the debt he said that midland should have already provided and since court is scheduled next week they would have to dismiss. Then this attorney for midland kept repeating the amount owed and flipping through the pages of the file like he was going to find the evidence in there. After about 3 minutes of this I said well if that is all can we get this taken care of because I have finals to study for. MY CASE WAS DISMISSED WITH PREJUDICE!!!!! YEAH. THANKS AGAIN FOR THE WEALTH OF KNOWLEDGE ON THIS SITE. IF I HADN'T FOUND THIS SITE I WOULD HAVE BEEN ONE OF THOSE UNFORTUNATE ONES THAT I WITNESSED TODAY BEING LED AWAY LIKE LAMB TO THE SLAUGHTER. You all ROCK!!!

Great to hear, another person equipt with knowledge of their rights delivers a right hook to Midland.

But you know Midland still won today, the three folks that you said admitted to the claim made by Midland probably would have fared as well as you did if they knew their rights. Don't like to shed a negative light on this great triumph, but it shows once again these creeps just play the percentages and still "win" even when they show themselves to be completly without any recourse against people like yourself.

Can I ask how long the whole episode took you to complete, how long ago were you served?

i was filed a summons in september of last year. This was the first day in court so I was quite surprised that it went away today. I expected them to harass me for a while longer, but oohhhh so glad they didn't.

Yes I did feel bad for the others. The first thing I did when I was served was get on line and start researching who these bottom feeders were. Like I said in my original post, I am soo glad that I found this site.

Wow, six months, well I bet it feels great to have this resolved in a positive fashion.

People can talk about the courts routinely taking a long time to cycle through cases and all, but I am sorry, these dirtbags should have more to lose when they file these things and put people through half a year or more of time,trouble, and worry and then just skip out on the whole thing when it is clear they don't have an easy judgement. There should be some sort of penalty there for them to suffer when they display that they had no proof to back up their suit.

I mean really, these courts should keep track of how many suits are dismissed due to the JDB not having any evidence to back their claim, and once they reach a certain number then they should be barred from being able to file anymore ever. I mean these are out of state companies (in most cases) that are using tax-payer funded courts to prey on those tax-payers. I mean am I crazy to think that something can't be done about this, I mean this notion that "anybody can file a lawsuit" is just offensive. These companies have routinely displayed that they are gaming the system and are regularly filing suits without any proof to back them up all in hope that they will get a default.

Only a system as corrupt as the establishment in this country could see that as a proper use of the "justice" system. It's time people really start grilling their legislators to make this a mega-priority to fix.

I hope I have as much luck as some of you had. I just bombarded Midland with lots of paper this week. Took the advice of the brilliant minds on this board and consulted an attorney for some guidance. Luckily the person I chose had experience with dirtbags like Midland. I told her I wouldn't settle with them because they had to prove they owned it. She helped me amend my answers, defenses and actually drafted a counterclaim because those jacka**** re-aged the account on my credit report in addition to calling my brother and HIS mother-in-law. Midland's complaint was filed out of one of their attorney's offices in Miami then they filed a Motion to Strike my answer out of a different office. I bet they have nothing and are trying to scare me. The attorney I went to was very impressed with my knowledge and all of the documents I was able to drafted thanks to this board. She said that she likes to help people and having "walked on the dark side" by working for a JDB she sleeps better at night now. She said that when she appears in court that the JDB atty's are not happy. If I need her, I will hire her, but I hope I can handle it myself.

keep all relevant documents in a safe place. i usually like to scan the final order and send an email to myself with a pdf copy. this way i can access it from anywhere if i ever moved, lost it, flood, etc. (easy access to print and send to the CRA if need be)

this is a great win. you did the research, did the work, and brought your best foot forward.

CLASSIC!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! i think that made the attorney very very very mad LMAO 8-)
